The Driver License Division is not the DMV

Start here, because it is the single most common error in Utah study material. The Driver License Division sits inside the Department of Public Safety and handles learner permits, licenses, testing and driving records. The Utah DMV is a different agency entirely, under the State Tax Commission, and it deals with registration, plates and titles.

The official handbook goes out of its way to say so, which tells you how often people get it wrong. If a site tells you the Utah DMV will issue your permit, it has not read the source it claims to summarize.

80% to pass, and it is not on the test page

Utah asks for 40 correct out of 50 on a closed-book exam. The Division publishes the question count and the study material, but not the threshold. The 80% requirement is written into Utah Administrative Code R708-39-4 and repeated in the driver handbook.

An applicant who has been licensed before takes a shorter 25-question open-book version instead. You may sit two tests in one day, and the $19 fee covers three attempts within 12 months before a second fee is due.

The holding period depends on how old you are

Utah does not use one flat waiting period, and this is where copied study pages fall apart. They print six months for everybody, which is wrong for every adult applicant.

  • Age 15 — six months, and until you turn 16
  • Age 16 to 17 — six months
  • Age 18 — no holding period, but driver education is still required
  • Age 19 and over — 90 days, waived entirely if you complete an approved driver education course

Everyone owes 40 hours of supervised practice with 10 of them after sunset, unless you are 19 or over and have completed driver education.

There is a second exam, and it needs 100%. Every first-time applicant for a regular Class D license must also pass the Traffic Safety and Trends Exam. It is offered only on the Division website, half its questions cover the leading causes of traffic deaths in Utah, and you may retake it as often as you need — but you cannot get a single question wrong.

Two permits, two validity periods

Search for how long a Utah permit lasts and you will find both 18 months and 12 months. Both are right, because Utah issues two different permits.

  • The entry-level learner permit is valid for 18 months, and the written test scores attached to it last 18 months
  • For the six-month renewal permit, written knowledge test scores are valid for 12 months

Renew the permit or let it lapse and you retake the written test. Testing left unfinished six months after you paid your fee also has to be repeated.

An out-of-state permit counts, but you still cannot drive on it

These two rules sit in different documents and read like a contradiction until you line them up. The Division will count time you held an out-of-state learner permit toward the six-month holding period. The handbook is equally clear that a driver holding an out-of-state learner permit may not drive in Utah.

Both are true. The credit is for paperwork; it is not permission to get behind the wheel before you have a Utah permit in your hand.

Teen restrictions

Once licensed at 16 or 17, two limits apply. No driving between midnight and 5 a.m., unless a licensed driver 21 or older is with you, or you are going to or from work, an agricultural operation, a school-sponsored activity, or dealing with an emergency.

And for the first six months or until you turn 18, no passengers outside your immediate family. A licensed adult of 21 or over in the passenger seat, an agricultural operation, or an emergency lifts it. Utah credits its graduated program, in place since 1999, with a large fall in teen driver deaths.

Utah points are on a scale of their own

Do not compare Utah point totals against another state. Utah assigns much larger values per offense, so the suspension thresholds are correspondingly large.

  • Drivers 20 and under: 70 points in three years may bring a suspension of 30 days to a year
  • Adults: 200 points in three years may bring a suspension of three months to a year
  • Reckless driving is 80 points, texting while driving is 50, and running a red light is 50

Recovery is generous. One clean year removes half your points, two successive clean years removes all of them, and any individual conviction drops off after three years anyway. An approved defensive driving course removes up to 50 points and can be used once every three years.

Testing in another state?

The spread is wide. Idaho demands 85% across 40 questions, West Virginia passes you at 76% but charges for every attempt, and New Hampshire has no learner permit at all. Compare them all on our states page.
